Terms of Service

The agreement that governs your use of MossImage, its credits and the images you generate

These Terms of Service (the "Terms") are an agreement between you and [Company legal name], the entity that operates MossImage ("MossImage", "we", "us"). They cover the website at mossimage.pro, the AI image generator, the knowledge base and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use MossImage, or at least 16 if you live in the European Economic Area or the United Kingdom. If you are under 18, you may only use the Service with the permission of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your account

You can create an account with an email address and password, or by signing in with Google. You are responsible for keeping your credentials secure and for all activity under your account. Tell us immediately if you believe your account has been compromised.

You may delete your account at any time from your settings. Deletion removes your profile data and generated images within 30 days. Credits remaining in a deleted account are forfeited unless they qualify for a refund under section 4.

3. Credits and payments

MossImage sells one-time credit packs. There are no subscriptions and no recurring charges. The credit cost of each generation is shown before you confirm. Purchased credits never expire.

Payments are processed by Stripe or another PCI-compliant payment processor. We never store your card number. Prices are shown at checkout before you pay and may include applicable taxes. We may change credit-pack prices or generation costs at any time; changes do not affect credits you already bought.

New accounts receive a small number of free sign-up credits, which expire 30 days after sign-up. Generated images are delivered without a watermark. Some options, such as 2K output, become available only after your first credit-pack purchase.

4. Refunds

  • Failed generations. If a generation fails and no image is produced, the credits used are refunded to your balance automatically.
  • Unused credit packs. You may request a refund of a credit pack within 14 days of purchase, provided you have used fewer than 10% of the credits in that pack. The refund goes to your original payment method, and the pack's remaining credits are removed from your balance.
  • Other cases. Apart from the above, credits are non-refundable, except where your country's consumer protection law gives you a right we cannot exclude.

To request a refund, email support@mossimage.pro from your account's email address with the purchase date.

5. How generation works

When you submit a prompt, MossImage sends your prompt, settings and any reference image to a third-party AI model provider. We currently use Google image models through the Kie.ai API and may add other providers, including a self-hosted deployment of the open-source MOSS-Image model. Providers may keep inputs and outputs temporarily; see our Privacy Policy for details.

AI models are imperfect: results may be inaccurate or not what you asked for, and the same prompt can produce different images each time. We do not guarantee any particular result, and credits are consumed whenever an image is successfully generated.

6. Your content

Inputs. You keep all rights you have in the prompts and reference images you submit ("Inputs"). You must have the right to upload any reference image you use, including any people or copyrighted works it shows.

Generated images. As between you and MossImage, you own the images generated from your Inputs ("Outputs") to the extent permitted by applicable law. We make no claim to your Outputs. Note that copyright law in many countries does not protect fully AI-generated images, and other users may produce similar images from similar prompts.

Licence to us. So that we can run the Service, you grant MossImage a worldwide, non-exclusive, royalty-free licence to store, process, reproduce and display your Inputs and Outputs to show them in your account, send them to the model provider, create thumbnails and keep backups. This licence ends when you delete the content or your account, subject to the retention periods described in the Privacy Policy.

Product improvement. We may use anonymised prompts (with your account identity removed) to improve the Service unless you opt out in settings. We do not use your reference images or Outputs to train models.

Responsibility. You are responsible for your Inputs and for how you use your Outputs, including making sure that use is lawful and respects others' rights.

7. Acceptable use

You must not use MossImage to create, upload, request or share content that:

  • is illegal or promotes illegal activity;
  • is sexual content involving minors, or sexualises anyone who is or appears to be under 18;
  • is intimate or sexual imagery of a real person without that person's consent;
  • impersonates a real person in a deceptive way, including deepfakes intended to mislead;
  • infringes someone else's copyright, trademark or other rights;
  • promotes hatred or violence against people based on race, ethnicity, religion, gender, sexual orientation, disability or similar characteristics;
  • harasses, threatens or bullies anyone.

You also must not:

  • try to bypass safety filters, credit limits or access controls;
  • scrape the Service, send automated requests without our written permission, or resell access;
  • upload malware or interfere with the operation of the Service;
  • use the Service to build a dataset or train a model that competes with MossImage.

8. Enforcement

We may review content that is reported or flagged by automated systems. If we believe content violates these Terms, we may remove it, refuse to generate it, warn you, suspend or terminate your account, and where required report it to the authorities. Credits in a terminated account are not refunded if termination results from a violation of section 7. If you believe we have made a mistake, email support@mossimage.pro.

9. Our intellectual property

The MossImage name, logo, website design, software, knowledge base articles and other materials we create are owned by us or our licensors and are protected by copyright, trademark and other laws.

MOSS-Image is an open-source model developed by OpenMOSS. MossImage is independent and is not affiliated with or endorsed by OpenMOSS. Use of any open-source model within the Service is subject to that model's own licence.

10. Availability and changes to the Service

We work to keep MossImage available but do not guarantee uninterrupted service. We may change, add or remove features, model providers or free-tier limits at any time. If we shut down the Service, we will give you reasonable notice so you can download your images and request a refund of unused credits.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and accuracy of Outputs. Nothing in these Terms limits rights that consumer law gives you and that cannot be waived by agreement.

12. Limitation of liability

To the fullest extent permitted by law, MossImage and its team will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to what you paid us in the 12 months before the claim arose. These limits do not apply to liability that the law does not allow us to limit.

13. Indemnity

If someone brings a claim against us because of your Inputs, your use of Outputs or your breach of these Terms, you agree to cover the reasonable costs and damages we incur, where your local law allows.

14. Governing law and disputes

These Terms are governed by the laws of [Jurisdiction], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [Jurisdiction], unless the consumer law of your country of residence gives you the right to bring a claim locally.

15. Changes to these Terms

We may update these Terms. We will post the new version here and update the "Last updated" date. For material changes we will notify you by email or in the app at least 14 days before they take effect. Using the Service after that date means you accept the new Terms.
